Currently the Commonwealth Property Protection Association is pursuing 4 cases in the Courts. These cases cover a range of now questionable activities which include the legitimacy of certain Acts passed by State Governments especially those supported and often funded by the Commonwealth, in regard to there removal of property rights, and regards to their removing owners rights to, vegetation, timber, water, coal and carbon, nuisance and regulatory takings.
This has had a flow on effect in areas like Council Rates, which are being charged on land that cannot be used because of laws attempting to prevent its lawful use. Also the impact on regulatory takings as in National Parks and their impact on Park neighbours and Councils rezoning and restricting development unreasonably - often to suit large developers and special interest groups.
"Fire Hose Phil", NSW Environment Minister, who admits knowing nothing of marine biology or marine park management based on facts and true science, he again has sent his underling Minister, Verity Firth, who you will see from her letter to the NSW South Coast, Narooma News, has no bloody idea at all about marine life.
Her credentials are Verity Helen FIRTH, BA, LLB (an arts degree and a Lawyer)
One would assume as a qualified litigator, when attacking a world expert on marine life and ecology, she would at least be armed with facts from an equal source.
But alas, when one enters the political party room cloning machine as a politician must do, fact and fiction are melded.
The party preservation come always first, even if facts are removed completely.
Ministers must never write their own letters or media release or
deliver them before the bureaucrats have edited the copy. The preferred method is for staff to completely constructed the document to be signed by "Yes Minister" -
as would seem the case in the below newspaper transcript. It may have been Ms Amy Person, on the staff, is fully qualified at minister manipulation and you pay her wages.

I write in response to your recent coverage (28 September) of a paper delivered by Professor Kearney, which challenges the validity of a Marine Parks Authority document that examines the benefits of marine parks.
The NSW Government stands by the rigorous scientific and public consultation processes it undertook prior to creating each of the State's six marine parks.
Far from going it alone on marine parks, NSW has been joined by a large and growing number of countries equally convinced by the science.
There is now broad, world-wide scientific consensus on the significant benefits of having protected marine areas and the basis for the development of these areas has been extensively documented in the scientific literature.
Earlier this year on World Oceans Day, 260 European scientists published a consensus statement calling for the establishment of marine parks to conserve biodiversity and marine life.
Even the Commonwealth Government has established its own network of marine parks.
Marine Parks and their sanctuary zones are not solely about protecting fish - they are designed to protect the whole spectrum of marine life, ensuring our marine environment continues to thrive into the future.
It is also worth pointing out that recreational fishing continues in the overwhelming majority of each marine park in either habitat protection zones or general use zones.
To have done nothing about the State's rapidly deteriorating coastal ecosystems - as some continue to advocate - would have been an abrogation of our fundamental responsibility to leave our natural environment in better shape than that which we inherited.
By better managing our marine biodiversity we can improve opportunities not only for fishing, but also for diving, whale watching and related tourism activities.
Ultimately, the approach taken by the NSW Government is the best way to ensure the current generation of recreational fishers does not become the last.

Bob Kearney, BSc (Hons), PhD, DSc, is Emeritus Professor of Fisheries at the University of Canberra.
He is currently Chairman of the Board of Trustees of the World Fish Centre, a member of the Research Committees of the Australia & Pacific Science Foundation
and the Pacific Biological Foundation, and a member of the Threatened Species Scientific Committee of the Commonwealth Department of Environment and Heritage.
He is the author of 150 scientific and technical papers and the recipient of more than $20 million in research grants.
Now if you missed this published previously in SOS-NEWS, here is some to compare with Ms Firth comments in the Narooma News she refers to.
The Science Paper is attributed as, "Prepared on behalf of the Marine Parks Authority Scientific Committee": an attribution which projects the full authorization of the
Authority and the scientists therein. The Marine Parks Authority's own assertion that this process will be driven by "thorough scientific assessments of all available information and data".
The documentation relating to the creation of the Batemans Marine Park is perhaps best described as very poorly disguised advocacy marketed to the unsuspecting public as science. This is a sham. So much so that not only does it totally discredit the Batemans Marine Park but it calls into question the credibility of the Marine Parks Authority and the justification of all existing and proposed marine parks in New South Wales.
An FOI (Freedom Of Information) request on information relating to the proposal for the introduction of the Batemans Marine Park revealed that NSW Department of Primary Industries, the State's fisheries management agency, in its communication with the Marine Parks Authority on the Batemans Marine Park before it was declared, actually listed four fish species it considered as growth-overfished in NSW:
snapper (Pagrus auratus), silver trevally (Pseudocaranx dentex), sea garfish
(Hyporhamphus melanochir) and kingfish (Seriola lalandi).
Disregarding this inconsistency between the fisheries management authority, NSW DPI, and the Marine Parks Authority on fisheries management, it is significant that neither agency provides any evidence for any current, or even anticipated problems, with predominantly estuarine or ocean beach species in NSW.
Tony Fleming, outgoing Directeor of NSW National Parks also had published his twenty cents worth in the Narooma News and was much in the same vein as Minister Firths, as all spin seems to be.
Prof Kearney submitted his reply to Fleming, but Narooma did not print it, neither did the Batemans Bay News, controlled media at it's best protecting the fiction writers.
SOS-NEWS received a copy of his letter to the editor that you may read, because we publish facts and do not have a puppet master pulling our strings.
I am responding to your article "Critics call for marine parks to go", 29/9/07, and in particular the statement, "MPA's Tony Fleming said Professor Kearney's critique had a number of flaws".
Primarily, I am supposed to have "confused the paper - which was for the general public - with planning principles for marine parks which had been developed over a number of years". I did indeed comment on the papers which were "for the general public" because these were the ones the public was given during the consultation period as the justification for the Batemans Marine Park. If it now turns out, as Tony Fleming contends, that there are other principles which over-ride the ones given to the general public then the whole consultation process was a sham and a waste of time for the general public and all who accepted the Marine Parks Authority's invitation to contribute.
My paper pointed out that the documentation given to the public on the justification of the Batemans Park was grossly and consistently biased and abused the principles of sound and objective science. Correct interpretation of the science quoted by the Marine Parks Authority shows that the Batemans Marine Park will not protect the estuarine or beach ecosystems against even the threats identified by the Marine Parks Authority.
If, as Tony Fleming contends, "It is clear that the protection offered by marine parks also relies on a range of other estuarine and marine management initiatives that we have in place", what are these other initiatives, additional to the obvious restrictions on fishing, and why were they not set out in the documentation given to the public and included in the scientific assessment of the collective actions? It would appear even Ministers Debus and Macdonald were not aware of these other alleged significant restrictions, otherwise why would their joint Media Release of 14 July 2006 on the Batemans Draft Zoning Plan state, "People can generally continue to do what they've always done within the sanctuary zones except commercial and recreational fishing"?
Fleming's statement, "The key threats that are managed by marine parks include some damaging types of fishing, such as fish and prawn trawling" confirms rather than counters my assessments. Again, the only threat that the Batemans Park attempts to 'manage' is fishing. And again, no evidence is given as to how even fish and prawn trawling are damaging and absolutely no assessment is provided on why exclusion of these activities from small areas of the coast represents the most effective or efficient management. If these activities can be shown to be damaging then this damage should be managed over the whole of New South Wales by the legislated fisheries management agency, the Department of Primary Industries.

It does explain how we see public submissions for environment matters open for just a week or two prior to legislation being implemented, for the last thing these sleaze operators want is people input and facts destroying their agenda.
It must be real hell when they have to contend with a world expert who has just shot holes in their fairytales. But acts of parliament passed at midnight have their backsides covered in all directions except one - now wide open and ready to use - but that is our secret at this time for we do not wish to see a mass exodus of rats from the ship before legal retribution can be delivered.
